Arbitration Services

We provide arbitration services as a means of resolving disputes outside the courts where the parties have agreed to arbitrate. Our services include drafting arbitration agreements and clauses, assisting with the selection of arbitrators and the constitution of the arbitral tribunal, representing parties in arbitral proceedings before the tribunal, and handling post-award proceedings before the competent court, in accordance with the Arbitration Law and its Implementing Regulations and, where chosen, the rules of institutional arbitration centers, in commercial and civil disputes.

Frequently Asked Questions

The arbitral award is issued by the arbitral tribunal, not by a party to the dispute or its representatives. Paragraph (1) of Article 14 of the Implementing Regulations of the Arbitration Law provides that the chairman of the arbitral tribunal pronounces the award after the closing of the pleadings.

Paragraph (1) of Article 10 of the Arbitration Law, as amended by Royal Decree No. M/21 dated 26/1/1447H, provides that an arbitration agreement is valid only if made by a person who has the capacity to dispose, whether a natural person or a legal person.

Where the arbitral tribunal consists of a sole arbitrator and the parties do not agree on the appointment, the competent court appoints the arbitrator upon request, under Article 10 of the Implementing Regulations of the Arbitration Law. Under Article 2 of the Regulations, the competent court is the court of appeal originally competent to hear the dispute, except in cases excluded by the Law.

An action for annulment of an arbitral award may be brought in the cases set out in Article 50 of the Arbitration Law, including where a party to the arbitration agreement lacked or had limited capacity at the time it was concluded, according to the law governing that party’s capacity. The action is not accepted from a claimant who waived the right to bring it after the award was issued, under paragraph (1) of Article 18 of the Implementing Regulations.

Under paragraph (2) of Article 18 of the Implementing Regulations of the Arbitration Law, the claimant must attach the original award or a certified copy, a true copy of the arbitration agreement, and an Arabic translation of the award certified by an accredited body if the award was issued in another language.
